Divorcing in California is different
California's divorce laws follow some of the strictest property rules in the country. Here's what matters most before you file.
01
You won't need to prove anyone did anything wrong
California doesn't require proving fault to divorce. The most common ground is “irreconcilable differences,” meaning the marriage has broken down with no reasonable chance of reconciliation.
04
You may still have property rights even in an invalid marriage
If a marriage turns out to be legally invalid but one spouse genuinely believed it was valid, California still divides the property as if the marriage had been real. This protection covers property, not spousal support.
02
Whatever you built together gets split right down the middle
California requires an equal, 50/50 split of community property, not a “fair” split based on contributions. Property owned before the marriage, or received as a gift or inheritance, usually stays separate, but you'll need documentation to prove it.
05
Some invalid marriages can be challenged any time
Some marriages, like incestuous or bigamous ones, are void from the start and can be challenged at any time. Others, like those involving fraud or a spouse who was underage, are voidable, meaning they stay legally valid unless someone takes action within a specific deadline.
03
Same-sex couples get a special filing option here
California's standard residency rule has a narrow exception for same-sex couples married in California who now live somewhere that won't dissolve their marriage. They can file in California without meeting the usual residency requirement.
06
You'll need to meet residency and waiting-period rules before you can finalize
Filing requires residency in the state and county first, and a mandatory waiting period applies before a divorce can be finalized, even by mutual agreement.

Courts consider factors such as the length of the marriage, income disparity, earning capacity, and each spouse’s standard of living.
