What Is Refugee Status?

Refugee status is a form of protection that may be offered to people outside the United States who cannot return to their home country because they fear persecution based on race, religion, nationality, political opinion, or membership in a particular social group. Refugee status allows people to legally enter, live, and work in the U.S. and eventually apply for a Green Card.

    • Definition under U.S. law: A refugee is someone outside their home country who is unable or unwilling to return due to a well-founded fear of persecution on one of the protected grounds.

    • Path to a green card: Refugees are generally required to apply for lawful permanent residency (a green card) one year after being admitted to the U.S.

    • Family reunification: Refugees may petition to bring a spouse and unmarried children under 21 to the U.S. through the refugee family reunification process.
